The Securities and Exchange Commission today (June 29) agreed to pay $775,000 to San Diego attorney Gary Aguirre. The sum represents four years and ten months of his salary since the agency fired him in 2005, plus his attorney fees. The story of the SEC’s blatant prostitution in the Aguirre case has been told on this blog and in my column several times before, but it is worth summarizing. In short, Aguirre’s ordeal is a story showing how the SEC, which was born in the 1930s to protect investors from Wall Street predators, became an agency that protected Wall Street predators from investors. Aguirre had good reason to believe that John Mack, head of Morgan Stanley, may have passed information to Pequot, then one of the most powerful hedge funds. But Aguirre’s supervisors told him that Mack had “juice” and “political clout.” Mack was a big fundraiser for George W. Bush. Prior to his pursuit of Mack and Pequot, Aguirre had been given a two-step pay raise for “consistently going the extra mile, and then some.” But after Aguirre wanted to interview Mack, Aguirre’s supervisors gave him a negative re-evaluation outside the SEC’s ordinary performance appraisal process.

San Diego Strip Clubs: Hundreds turn out for Gaslamp Bikini parade

SAN DIEGO – A couple of hundred bikini-clad women paraded through the streets of San Diego’s Gaslamp District Sunday afternoon in an attempt to break a world record.
Organizers of the San Diego Bikini Walk hoped to attract at least 325 bikini-wearing participants to break the current record for the largest bikini walk, which is 323, according to the Guiness Book of World Records.
Monday, Bikini Week organizers were still tallying up the official count, but they said that around 200 women participated. The walkers started their mile-long trek from the Hard Rock Hotel at about 1:30 p.m. Leading the pack was Michelle “Bombshell” McGee, a local stripper known for her affair with Sandra Bullock’s husband, Jesse James. The group walked down 5th Avenue to Market Street, then back up to Broadway before returning the Hard Rock Hotel for an after-party at the hotel pool.

In 2008 Lucy became homeless. Friends she was crashing with at the time needed to make room for their children, and there was no more space available.

Fourteen men were arrested Thursday night during a six-hour undercover prostitution operation in El Cajon.
Five female officers, four from the El Cajon Police Department and one from the county Sheriff’s Department, posed as decoys during the operation, which started around 7 p.m., said El Cajon police Lt. Steve Shakowski.
The men were all arrested on suspicion of soliciting and ranged in age from 21 to 47.
Police did not release the location of the operation.

San Diego Strip Clubs: Supreme Court limits law used to curtail fraud

What happened in the City Hall case? Former Councilmen Ralph Inzunza and Michael Zucchet were found guilty of corruption charges in 2005. They were accused of trying to relax a law that bans touching between strip club patrons and dancers, a change that would allow clubs to make more money. The federal government said Inzunza and Zucchet did so in exchange for campaign contributions from club owner Michael Galardi. U.S. District Judge Jeffrey Miller later overturned most of Zucchet’s convictions.
How does it relate to the Supreme Court ruling? The 9th U.S. Circuit Court of Appeals had upheld the lower court decisions, but delayed Inzunza’s 21-month prison sentence until the Supreme Court ruled on the “honest services” issue in a case involving former Alaska legislator Bruce Weyhrauch. The Supreme Court on Thursday ruled in favor of Weyhrauch, sending his case back for reconsideration.

Inzunza and Zucchet were convicted in 2005 for taking campaign contributions and trying to ease rules banning dancers and patrons from touching in San Diego strip clubs.

San Diego Strip Clubs: Supreme Court Ruling May Toss Out Local Corruption Cases

The U.S. Supreme Court handed a partial victory to former Enron chief Jeff Skilling on Thursday, as it ruled the “honest services” fraud statute used was too vague.
A narrowing of the scope of the statute, which also allows the federal government to go after local officials for corruption, could mean big headaches for prosecutors in some San Diego-area cases.
“The impact could be huge,” said former U.S. Attorney Chuck La Bella.
With the Supreme Court’s ruling that the law was too vague, La Bella pointed out, “What they’re saying is this provision can only be used to address traditional bribes or kickbacks. It can’t be used for improper conduct.”
The ruling may have an impact on local cases, including the so-called “Strippergate” case in 2003, where former San Diego City Council members were convicted of conspiring with a strip club owner to relax the “no-touch” laws.

San Diego Strip Clubs: REGION: Supervisors adopt restrictive medical marijuana ordinance

That drew the ire of Neal Plastik, who said the drug works far better for him than conventional painkillers.
“You shouldn’t be regulating people who are just trying to help other people,” he said.
Jacob’s amendment increased the minimum distance between dispensaries and homes from a proposed 500 feet to 1,000 feet, and from a proposed 600 feet from churches, parks and schools to 1,000 feet.
Valley Center’s Eugene Davidovich, spokesman for the group Americans for Safe Access, which claims a local membership of several thousand, contended that shuts out dispensaries entirely.
“What they have done is eradicate medical marijuana anywhere in the county,” he said after the meeting.
A county spokesman said planners maintain there are at least 15 potential sites under the guidelines, which mirror those in place for strip clubs. Three of those sites are in Ramona and two in the San Dieguito area.
