MILAN (AP) – Premier Silvio Berlusconi’s defense lawyers fought to get his sensational under-age prostitution trial moved out of the criminal courts on Tuesday as the Italian leader battled for his political future after suffering a withering defeat in local elections nationwide.
Berlusconi’s lawyer argued that the Italian leader was convinced that a Moroccan teen at the center of the scandal was indeed the niece of former Egyptian President Hosni Mubarak when he tried to get her out of trouble last May, and therefore was acting within his official duties and should be judged by a parliamentary body.
The trial resumed after a two-month break and the morning after late-night celebrations marking the defeat of Berlusconi’s candidates for mayor in his northern stronghold of Milan and in trash-plagued Naples. The results revealed a weakened Italian leader and heightened the impression that he is too distracted by his legal woes to govern effectively.

Sacramento Fearing higher costs during tight budget times, the Assembly Appropriations Committee Friday shelved two measures backed by San Diego County law enforcement leaders:
— Assembly Bill 1022 would have permitted residents to sign-up for email notifications when a convicted sex offender moved into the neighborhood. It was carried by Assemblyman Nathan Fletcher, R-San Diego.
Committee staff, in the analysis, estimated there would be significant one-time costs “in the hundreds of thousands of dollars.”
— Assembly Bill 918 sought to attack street gangs running prostitution rings. It would have added “pimping, pandering and human trafficking” to the list of penalties that carry more jail time for gang members. The measure was carried by Assemblyman Marty Block, D-San Diego.

Superior Court Judge David Szumowski rejected a defense bid to reduce bail for 26-year-old Daniel Dana from $300,000 to $50,000, saying he found it offensive that someone in law enforcement would allegedly betray the public’s trust.

A 34-year-old prostitute who Dana befriended told police she agreed to meet him about 3 a.m. May 11 in Presidio Park, where the officer allegedly forced her to have sex with him by threatening to arrest her if she refused.
During today’s bail review hearing, defense attorney William Wolfe said the circumstances of the meeting with the prostitute were “suspect” and no force was involved.
